Selvstændig bibeskæftigelse

Er du jobsøgende akademiker, kender du udfordringerne med at få økonomien til at hænge sammen. Samtidig vil du opleve, at manglende kontakt med arbejdsmarkedet sløver din profil og erfaringsgrundlag. Det er dog muligt at ansøge om godkendelse som jobsøgende med selvstændig bibeskæftigelse.

Reglerne for selvstændig bibeskætigelse er kort sagt, at du kan godkendes til selvstændig bibeskæftigelse, hvis du kan levere dine kerneydelser udenfor almindelig arbejdstid 8-18.  Bemærk, at der står kan levere. Som akademiker på dagpenge kan du i stort omfang tilrettelægge din egen hverdag, men du må ikke være afhængig af at holde møder med klienter, sådan som f.eks. psykologer er i forbindelse med deres konsultationer.


Du må heller ikke investere i inventar, marketing eller have en salgshjemmeside. Du må som alle andre borgere have en præsentationshjemmeside, der tegner en profil af dig som professionel med en række faglige kompetencer, men der må ikke være kalender (med mulighed for booking) eller angives CVR nummer på din virksomhed. Hjemmesiden skal være personlig. Du skal med andre ord lade kunderne komme til dig gennem netværk. Tænk dog på at personlige professionelle netværk jo også helst skal udbygges som en del af jobsøgningen. Du har med aktiviteter, der kan karakteriseres som selvstændig bibeskæftigelse, endnu en grund til at profilere dig selv og dine kompetencer så professionelt som overhovedet muligt i din kommunikation og anlægge en strategi for dette som et projekt i sig selv.

Udover en ansøgning til A-kassen, der p.t. udgøres af to blanketter er der en række andre formalia, der skal på plads. Din virksomhed må registreres og skal registreres på virk.dk, hvis du har en indkomst indenfor et år, der kræver, at du skal betale moms. Se aktuelle satser på skat.dk. Bemærk at der ikke skal betales moms af ydelser solgt til udlandet (se forskelle på EU-lande og ikke-EU lande på skats hjemmeside). Sørg for at din virksomhed udelukkende er momsregistreret, så du også kan få længerevarende opgaver.
Der er dog flere faldgruber. Du må som del i dine ydelser ikke købe materialer eller services hos andre (have underleverandører) heller ikke hvis materialer eller underleverandører er specificeret på en faktura. Tænk på din situation på følgende måde: Er jeg i et pågældende arbejdsforhold utvetydigt lønmodtager? Dette spørgsmål skal du stille dig selv, hver gang du foretager dig en administrativ opgave i forbindelse med din selvstændige bibeskæftigelse, din ansøgning om selvstændig bibeskæftigelse eller almindelig kontakt med aktører på jobmarkedet (ansøgning om uddannelse osv)

Du kan godkendes til flere forskellige former for selvstændig bibeskæftigelse, sørg for at registrere virksomheden med de rigtige branchekoder (hovedbranche, bibrancher...) Ønsker du at leje et værelse ud i egen bolig kræver dette en ansøgning til A-kassen, idet du ligeledes betragtes som jobsøgende med selvstændig bibeskæftigelse, som værelsesudlejer. Her er der andre regler, men de er mere klare end reglerne, der involverer dine kompetencer og færdigheder som jobsøgende.

Nedenfor ses et udkast til en kontrakt på engelsk, der i høj grad sikrer ovenstående krav.
Kontrakten er formatteret i LaTeX, der benyttes af dataloger, ingeniører, matematikere, statistikere, aktuarer, fysikere og mange andre med en naturvidenskabelig-teknisk baggrund.

Kan det være svært at overholde reglerne, men har du en virksomhed, der er ivrig efter at få dig til at løse en opgave, bør du forsøge at få virksomheden til at tegne en tidsbegrænset timebaseret kontrakt, hvor du i en periode (dage, uger, måneder) arbejder for virksomheden til en bestemt timeløn med eller uden pension etc. Se satser på din fagforeningshjemmeside. Det anbefales ofte at timesatser ganges med 1.5 eller 2, idet du sandsynligvis er alene i forhold til al ansvar for eget ve og vel herunder pension, efteruddannelse og visse forsikringsforhold. Lad være med at skrive under på kontrakter, der kan holde dig økonomisk ansvarlig for større beløb. Sørg for at virksomheden overholder funktionærloven i kontraktforpligtelserne så du ikke pålægges ansvar som andet end lønmodtager. Er du tidsbegrænset ansat på fuldtid/deltid kan du ikke samtidig modtage dagpenge medmindre du f.eks. søger om supplerende dagpenge.




Reglerne på området er desværre komplicerede og kan tolkes rigidt afhængigt af din A-kasse.
Vælg ikke en A-kasse, der politiserer, relativerer eller filosoferer på baggrund af deres medlemmers situation. Det har jeg selv oplevet ved MA-kasse, der nok mest af alt er for akademikere med ansættelse indenfor gymnasieundervisning og smalle humanistiske fag.
Skift A-kasse og fagforening så snart der er mulighed for det, hvis du udsættes for umenneskelig behandling, anmeld også forhold, der er personrettede. På matematik i både Aarhus, København, Odense og Aalborg fandtes og findes en lang tradition for at rekruttere til MA-kasse og Magisterforeningen på overbygningen af studierne i matematik, statistik og beslægtede fag som fysik, kemi, biologi ... Kræv din frihed og værn om demokratiet, dit arbejds- og privatliv før det bliver undergravet af politiske organisationer og deres forbindelser.

This Agreement is with respect to the
development of designs of experiments and data analysis for the Client, hereinafter referred to as the
``Work.'' Whereas, Consultant is a professional project manager, researcher and statistician of good
standing; Whereas, Client wishes Consultant to create certain Work described
more fully herein; and Whereas, Consultant wishes to create such Work; Now,
therefore, in consideration of the foregoing premises and the mutual
covenants hereinafter set forth and other valuable considerations, the
parties hereto agree as follows:


\section*{Nature and scope of services}

The Consultant will perform the following service(s) for the Client:

Collaborating with Client to establish requirements and priorities based on Client's business
goals; assistance in development of experimental designs and/or systems engineering and/or analysis of data and/or material for presentation of design, data and results in accordance with these requirements and priorities; and/or deployment of such services onto internet-accessible systems;
and administration of such systems. In support of these goals, Client is expected to work with Consultant to set priorities, review preliminary and final results monthly ({\bf Performance of Services}) and produce product research and specifications as required. Client and Consultant will arrange periodic internet meetings and discussions
to support this collaboration. The Client cannot demand meetings or delivery of services during ordinary office hours between 8AM (CET) and 6PM (CET), office hours are between 6PM (CET) and 7PM (CET) Monday-Thursday. All services are delivered thorugh ordinary mail and/or in electronic format.

\section*{Fees}

In consideration of the Consultant's services, Client will pay
Consultant at the rate of

Consultant will provide an invoice to the Client at the end of each calendar
month, indicating time worked each day during that month and the
amount due. Payment will be made to Consultant in DKR, by check or
wire transfer, within fourteen (14) days of receipt of the invoice. Travel,
living and any related out-of-pocket expenses, if authorized in writing by
Client, will be indicated on the invoice and reimbursed at cost.\\
The Consultant is entitled to payment
once a month of any expenses or services already performed. The
amount falls due within 14 days of receipt of invoice.
Interest on debt will be charged from the due date at the rate
of 1.5\% per month or fraction of a month. If the Client fails to pay
amounts due within 8 days of receipt of written notice, the
Consultant is entitled to terminate the consultancy and regard this
as a material breach of the contract.

Unless otherwise agreed, the amounts are exclusive of value
added tax (‘moms’).

\section*{Contract Length and Availability}

The full length of this contract is as follows:

Starting date is date of signature and end date is to be determined through mutual agreement or until such time as the contract is terminated per the terms described in this contract.

During this period, Consultant will guarantee availability of at least four (4)
hours per week for work on tasks selected by the Client. Client and
Consultant will review this time guarantee every four weeks and may adjust it
as agreed upon with two weeks notice.

Should the Consultant be rendered unable to work due to legal unemployment work and job search requirements, sickness, illness or accidents, the Consultant will notify Client at Consultant's earliest opportunity, and the guarantee of availability will not apply during those
weeks when the Consultant is unable to work.

The Consultant and Client may specify, by advance written agreement, that no
work shall be performed and no charges assessed during certain periods when
either party is unavailable. At present, Consultant expects to be available
for the full guaranteed time through twelwe months. {\em Official Danish holidays excluded}

The Client may demand an extension of time limits when services
or decisions of which he is in charge are delayed due to events
beyond his control and which he did not anticipate or should have
anticipated when the agreement was concluded.

If a time limit has been set for the completion and handing-over
of the project to the Client, the Consultant may demand an extension
of the time limit if the Client has demanded modifications of the
services, and these modifications delay the completion of the
project, or if the delay is otherwise caused by the Client.

The Consultant may demand an extension of the time limit for
reasons of delay beyond the control of the Consultant, and which he
did not anticipate or should have anticipated when the agreement was
concluded.

\section*{Performance of Services}

If the contract or the contractual basis does not provide
sufficient guidance for the performance of services, the Consultant
will obtain the Client’s decision hereon.

The services will be deemed to have been completed when they
reach the Client.

However, within three weeks after the completion of the
services, the Client may provide a written notice listing
defects he intends to rely.

Defects which are not ascertained and claimed to be remedied at
the handing-over procedure cannot be relied on by the Client at a
later time.

The Consultant will have a reasonable time limit to remedy any
defects. The fixing of the time limit should consider the nature and
scope of the defects and other matters.

After remedy of the defects, the services will be deemed to
have been finally completed.


\section*{Variation of Services}
The Client is entitled to require variation of the services when
necessary or in the ordinary course of the performance of the
services. The Consultant is entitled to carry out such variation,
unless the Client can establish specific reasons to justify that the
commissioning party lets a third party perform the services.

Any demands by the parties to modify rates, time and other
matters in connection with variation of the services must be
specified in a written addendum. Additional services in connection
with variation of the contract will be paid on an hourly basis
according to time spent on the performance of the services, unless
otherwise agreed between the parties.

Demands for variation must be in writing. The Consultant must
have reasonable time to reply whether he will perform the variation,
and his terms for doing so, refer to the previous paragraph.

\section*{Confidentiality}

The Client and Consultant may disclose confidential information one to the
other to facilitate work under this Agreement. Such information shall be so
identified in writing at the time of its transmittal, and shall be
safeguarded and not disclosed to third parties by the receiving party.
Confidential information shall not include information that:

\begin{enumerate}
\item is already known to the party to which it is disclosed;
\item is or becomes part of the public domain without breach of this Agreement;
\item is obtained from third parties, which have no obligations to keep
confidential to the parties to this Agreement.

\section*{Permissions and Releases}

The Client agrees to indemnify and hold harmless Consultant against any and
all claims, costs, and expenses, including attorney's fees, due to materials
included in the Work at the request of the Client for which no copyright
permission or previous release was requested or uses which exceed the uses
allowed pursuant to a permission or release.

\section*{Independent Contractor}

The Client and Consultant are independent parties and nothing in this
Agreement shall constitute either party as the employer, principal or
partner of or joint venture with the other party. Neither the Client nor
Consultant has any authority to assume or create any obligation or
liability, either express or implied, on behalf of the other.

\section*{General}

Work is delivered as-is without responsibility on behalf of the Consultant and without warranties of any kind. Any economic demand or compensation, costs to procedure etc forced upon the Consultant cannot exceed the fee received by the Consultant half a year from the unset of the dispute.
Contracts will be governed by Danish law. If any provision of this Agreement is held by a court of competent
jurisdiction to be invalid, void, or unenforceable, the remaining provisions
will nevertheless continue in full force and effect, and the parties shall,
in good faith, attempt to modify the invalid provision so it becomes a valid
provision.

This Agreement constitutes the entire understanding and agreement of the
parties and supersedes all prior written or oral agreements with respect to
the subject matter of this Agreement. This Agreement may not be modified or
amended without the express written agreement of both parties. Waiver of any
provision of this Agreement by a party shall not constitute a waiver of any
other provision or waiver of the same provision at any other time.

her organization or business with authorization to enter into supplementary agreements in connection with this Contract.\\\\
